General Terms and Conditions
A BLINK FILM GmbH, Ankerstrasse 8, 8004 Zürich (“ABF”)
UID / VAT: CHE-318.016.433 MWST
Version: October 2026
1. Scope
These terms apply to all services of ABF, in particular film production, service production, camera and cinematography work, and the rental of equipment. Different terms of the client apply only if ABF agrees to them in writing. Individual agreements in an offer or contract take precedence over these terms.
2. Offers and contract
Offers are valid for 30 days unless stated otherwise. A contract is formed when ABF confirms the order in writing (email is sufficient) or starts the work.
3. Services and cooperation
ABF performs its services with professional care. The client provides in good time all information, materials, permits, locations and approvals needed. Delays caused by the client may lead to additional costs.
4. Prices and payment
All prices are in Swiss francs (CHF), plus VAT. Unless agreed otherwise, ABF invoices 50% on order and 50% on delivery. Invoices are payable within 30 days, without deduction. Extra work, overtime or changes requested by the client are charged in addition, based on the agreed rates or ABF’s current rates. Shooting days follow the standard working hours of the Swiss film industry (SSFV terms), unless agreed otherwise.
5. Cancellation and postponement
If the client cancels or postpones an agreed production or rental, the following fees apply as a share of the agreed fee:
– more than 14 days before the start: 25%
– 14 to 7 days before: 50%
– less than 7 days before: 100%
Costs already incurred (e.g. bookings, travel, third-party services) are charged in full.
6. Weather and force majeure
ABF is not liable for delays or cancellations caused by events outside its control, such as extreme weather, illness, official orders, strikes or technical failures of third parties. In such cases the parties agree on a new date in good faith.
7. Rights of use
All copyrights in the footage and works created by ABF remain with ABF until full payment. After full payment, the client receives the rights of use agreed in the offer or contract (purpose, territory, duration, media). Any further use requires written consent. ABF may show the work in its portfolio, on its website and at festivals, unless agreed otherwise in writing.
8. Raw material and archiving
Raw footage remains with ABF unless agreed otherwise. ABF keeps project data for 6 months after delivery but does not guarantee long-term storage. Delivery of raw material or longer archiving can be agreed for a fee.
9. Cinema Equipment Rental
a) Rental starts with handover and ends with return of the equipment, complete and in the same condition.
b) The renter is liable for loss, theft and damage from handover to return, including by third parties, and must insure the equipment accordingly. ABF may ask for a deposit and proof of insurance.
c) The renter must check the equipment on handover and report defects at once. Equipment may only be used by qualified persons and must not be passed on to third parties without ABF’s consent.
d) Late return is charged at the daily rate for each extra day.
10. Liability
ABF is liable only for damage caused intentionally or by gross negligence. Liability for slight negligence, indirect damage, lost profit and data loss is excluded as far as the law permits. Total liability is limited to the fee for the order concerned.
11. Confidentiality
Both parties treat confidential information from the other party as confidential, also after the end of the contract.
12. Data protection
ABF processes personal data in accordance with its privacy policy (ablinkfilm.com/privacy).
13. Final provisions
If any provision is invalid, the rest of these terms remain in force. Changes must be made in writing. Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction is Zürich, Switzerland.
